Notice from the General Office of the National Health Commission on Issuing the 2020 National Random Supervision and Sampling Plan

In order to further strengthen the supervision and law enforcement of public health, infectious disease prevention and control, occupational health, and medical health, in accordance with the work deployment requirements of the State Council on "double random and one open", our committee has organized the formulation of the 2020 National Random Supervision and Sampling Plan (hereinafter referred to as the Plan, which can be downloaded from the website of the National Health Commission).

To the health commissions of all provinces, autonomous regions, municipalities directly under the central government, and the Xinjiang Production and Construction Corps, as well as the Chinese Center for Disease Control and Prevention and the Commission Supervision Center:  In order to further strengthen the supervision and law enforcement of public health, infectious disease prevention and control, occupational health, and medical health, in accordance with the work deployment requirements of the State Council on "double random and one open", our committee has organized the formulation of the 2020 National Random Supervision and Sampling Plan (hereinafter referred to as the Plan, which can be downloaded from the website of the National Health Commission). The relevant matters are hereby notified as follows:

1、 Supervision and spot check content

(1) Hygiene management of schools, public places, drinking water supply units, and centralized disinfection service units for tableware and drinking utensils;

(2) Management of vaccination in medical and health institutions, reporting and control of infectious disease outbreaks, implementation of disinfection and isolation measures, management of medical waste, and biosafety management of pathogenic microorganism laboratories;

(3) Production and operation of disinfection products and products related to drinking water hygiene and safety;

(4) The legal practice of medical institutions, blood collection and supply institutions, radiation diagnosis and treatment institutions, occupational health technical service institutions, radiation health technical service institutions, occupational health examination and occupational disease diagnosis institutions, maternal and child health care, and family planning technical service institutions;

(5) In 2019, the implementation of rectification measures by units that were subject to administrative penalties was randomly supervised and inspected by the state;

(6) Consolidate and implement the long-term mechanism for investigating and punishing illegal and irregular use of human assisted reproductive technology, conduct a "review" of the work situation, increase the crackdown, and strictly investigate and punish according to law and regulations.

2、 Organize and implement well

(1) Each region should formulate implementation plans according to the plan and organize their implementation. When formulating the random supervision and inspection plan for this jurisdiction, all national random supervision and inspection tasks should be included.

(2) Each region should establish a list of law enforcement inspection objects and law enforcement inspection personnel based on the health supervision information system, and regularly update them according to the actual situation. Please complete the consolidation of bottom file information in each province before April 10, 2020, clean up expired and unclosed bottom file information, and supplement and improve the filing work of supervised units in various sampling specialties; Complete the update of law enforcement inspection personnel information, and the number of supervisors participating in front-line supervision and law enforcement by county (district) level supervisory agencies shall not be less than 70% of the total number of personnel in the agency.

(3) All regions should actively strive for financial support at all levels and increase the guarantee of national random supervision and inspection work; Strengthen business training and enhance the ability of law enforcement inspectors to identify problems; Strengthen guidance, supervision, and inspection of subordinates to ensure the smooth implementation of national random supervision and inspection work.

3、 Standardize the selection and issuance of national random supervision and inspection tasks

(1) The Supervision Center of the National Health Commission formulated random selection rules and methods according to the plan. In April 2020, a list of inspection objects was selected from the list of law enforcement inspection objects in the national health supervision information system, and corresponding law enforcement inspection personnel were randomly matched from the list of law enforcement inspection personnel.

(2) The Supervision Center of the National Health Commission shall, within 5 working days from the completion of the task selection, submit the list of spot check tasks to the provincial supervision institution through the health supervision information platform. After receiving the task list, the system administrator of the provincial supervisory agency shall promptly submit it to the provincial health administrative department.

(3) In principle, all regions (except Hubei Province) are not allowed to adjust the national random supervision and inspection tasks without authorization. The national random supervision and inspection tasks in Hubei Province will be adjusted and determined separately. During the execution process, if law enforcement inspectors have special reasons that make it difficult to carry out spot checks, the provincial health administrative department shall make adjustment decisions and make specific adjustments in the national health supervision information system. The adjustment ratio shall not exceed 15% of the total number of sampled personnel in principle. In principle, all regions are not allowed to delete the bottom file information of law enforcement inspection objects without authorization. If it is necessary to delete due to heavy trucks, input errors, etc., the provincial-level supervisory agencies shall uniformly operate the deletion, and the corresponding double random inspection task shall be set as completed.

(4) The testing tasks involved in spot checks are generally undertaken by local disease control agencies. If they do not have the corresponding testing capabilities, they can be undertaken by third-party testing agencies.

4、 Pay attention to the connection between national random supervision and inspection and related work 

(1) Each region should ensure the connection between national random supervision and spot checks and local daily supervision work, and make national random supervision and spot checks a part of the daily supervision workload for overall arrangement. During the execution of random inspection tasks, other daily supervision and inspection items can be integrated to jointly carry out inspections. For the same inspection object, efforts should be made to complete the sampling items at once while considering the needs of various professions, in order to avoid unnecessary interference with the inspection unit. If any illegal behavior is found to meet the conditions for filing a case, it must be resolutely filed and investigated to maintain the seriousness of national random supervision and inspection.

(2) Each region should combine the supervision and spot check of infectious disease prevention and control with the comprehensive evaluation of the classification supervision of infectious disease prevention and control in medical and health institutions. The selected units should be inspected through the comprehensive evaluation of classification supervision. In view of the prevention and control of COVID-19, medical waste disposal and biosafety supervision and inspection of pathogenic microorganism laboratories were strengthened. It is necessary to promptly report the comprehensive evaluation results to the local business management department, incorporate the evaluation results into daily management measures, and link them with the scoring of bad behavior in medical institutions, level evaluation, verification, performance evaluation of medical and health institutions, and standardized evaluation of grassroots medical institutions.

(3) In addition to completing the plan, various regions should combine local work reality, adhere to problem orientation, carry out targeted health supervision and law enforcement work, and effectively safeguard the health rights and interests of the masses. If random inspections are applied for supervision and law enforcement, a double random method should be adopted. We should actively explore the use of handheld law enforcement terminals and full process law enforcement recording devices to improve administrative law enforcement efficiency and enhance law enforcement fairness.

5、 Timely disclose and report the results of national random supervision and inspection in a timely manner

(1) After the completion of the spot check task, all regions should follow the principle of "who checks, who enters, and who makes public", and publicly disclose the information of the spot check results through the local official website in accordance with the law. The information of the spot check results includes four categories: no problems found during the spot check, problems found and ordered to be corrected, administrative penalties, and inability to contact (such as the unit being closed at the time of inspection, administrative law enforcement documents not being delivered and not being fulfilled or closed). Information that has not been found to have problems, has been ordered to correct problems, and cannot be contacted shall be made public to the public within 20 working days from the completion of the spot check task. Administrative penalty information shall be made public to the public within 7 working days from the date of making the administrative penalty decision.

(2) Each region should report relevant information on time through the health supervision information system in accordance with the requirements of the plan (see attachments 1-4).

(3) The Supervision Center of the National Health Commission is responsible for collecting and summarizing data information reported by various regions, organizing business experts to analyze the statistical results, and submitting semi annual and annual reports to the Supervision Bureau of our commission before July 15 and November 30, 2020, respectively.
